Please read these Terms & Conditions carefully before using the INDIL platform. By downloading, registering, or using the INDIL application or website, you agree to be bound by these terms. If you do not agree, please do not use our services.

About INDIL

INDIL is a last-mile delivery platform founded in 2022 and operated in The Gambia. The name "INDIL" means "bring" in Wollof, reflecting our mission to connect customers with local businesses and deliver goods and services efficiently across The Gambia.

INDIL operates a mobile-first platform available on iOS and Android, enabling customers to place delivery orders, browse products from registered businesses, and make payments through multiple methods. INDIL also provides a business-facing application enabling merchants to manage their catalogues, orders, and finances.

These Terms & Conditions ("Terms") govern your access to and use of the INDIL application, website, and all related services (collectively, the "Platform"). By accessing or using the Platform, you enter into a legally binding agreement with INDIL.

Eligibility & Registration

To use the INDIL Platform, you must:

  • Be at least 18 years of age, or have the consent of a parent or legal guardian;
  • Provide accurate, current, and complete registration information;
  • Maintain the security of your account credentials and not share them with any third party;
  • Notify INDIL immediately if you believe your account has been compromised.

INDIL reserves the right to refuse registration or terminate any account that does not comply with these Terms or applicable laws.

Registration on the INDIL Customer App is free of charge. Business registration is subject to the terms set out in Section 8.

Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Platform in any way that violates any applicable law or regulation in The Gambia or any other applicable jurisdiction;
  • Attempt to gain unauthorised access to any part of the Platform or its related systems;
  • Transmit any unsolicited or unauthorised advertising or promotional material;
  • Engage in any conduct that restricts or inhibits any other user's use or enjoyment of the Platform;
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Platform without express written permission from INDIL;
  • Use any automated means to access the Platform, including bots, scrapers, or crawlers.

INDIL reserves the right to suspend or terminate your access to the Platform at any time for any breach of these Terms, without notice.

Orders & Delivery

When you place an order through the INDIL Platform, you are entering into a transaction with the registered business from whom you are purchasing. INDIL facilitates the transaction and the delivery but is not the seller of goods unless explicitly stated.

Order placement: Once an order is placed and confirmed, it is passed to the relevant business for preparation and to an INDIL rider for collection and delivery.

Delivery times: INDIL aims to deliver orders as quickly as possible. Estimated delivery times displayed in the app are indicative only and may vary based on distance, traffic, weather, and business preparation times. INDIL's on-time delivery rate is 99%, but we cannot guarantee specific delivery times.

Delivery areas: INDIL operates within defined delivery zones in The Gambia. Orders can only be placed for addresses within active delivery zones. You may place an order on behalf of someone located within a delivery zone from anywhere in the world.

Failed deliveries: If a delivery cannot be completed due to an incorrect address, unavailability of the recipient, or other circumstances beyond INDIL's control, INDIL will attempt to contact you. Repeated failed delivery attempts may result in order cancellation without refund.

Payments & Pricing

INDIL supports the following payment methods:

  • Debit and Credit Card (Visa, Mastercard, and American Express)
  • Apple Pay
  • Google Pay
  • Afrimoney (mobile money)
  • Wave (mobile money)
  • INDIL Wallet
  • Cash on delivery

All prices displayed on the Platform are in Gambian Dalasi (D) and inclusive of any applicable charges unless otherwise stated. Delivery fees, where applicable, will be displayed clearly before you confirm your order.

INDIL is not responsible for any foreign exchange fees, bank charges, or surcharges imposed by your card issuer or payment provider. By completing a payment, you confirm that you are authorised to use the payment method provided.

INDIL Wallet

The INDIL Wallet is a digital balance associated with your INDIL account that can be used to pay for orders and to send funds to other INDIL users.

Top-up: You may add funds to your INDIL Wallet using any of the supported payment methods. Funds added are non-refundable except in exceptional circumstances at INDIL's sole discretion.

Sending money: You may transfer funds from your Wallet to another registered INDIL user. INDIL is not responsible for transfers sent to incorrect accounts. Please double-check all transfer details before confirming.

Security: You are responsible for maintaining the security of your account. INDIL will never ask for your password or full payment details via email, SMS, or phone.

Expiry: Wallet balances do not expire while your account remains active. INDIL reserves the right to freeze or close Wallet balances associated with accounts that are suspended for breach of these Terms.

Cancellations & Refunds

Customer cancellations: You may cancel an order free of charge before it has been accepted by the business. Once accepted, cancellations may be subject to a partial or full charge. Once a rider has collected the order, cancellation is not available.

Business cancellations: If a business cancels an order after acceptance (e.g. due to stock unavailability), you will receive a full refund to your original payment method or INDIL Wallet within 3–5 business days.

Refunds: Refund requests relating to order quality, missing items, or incorrect orders should be raised through the INDIL app within 24 hours of delivery. INDIL will investigate and, where appropriate, issue a refund or credit to your INDIL Wallet. INDIL reserves the right to decline refund requests that cannot be substantiated.

Delays: INDIL does not offer refunds solely on the basis of delivery delays unless the delay is excessive and attributable to INDIL's negligence.

Business Accounts

Businesses registering on the INDIL platform ("Merchants") agree to additional obligations beyond those applicable to standard users, including:

  • Providing accurate and up-to-date information about their business, products, and pricing;
  • Ensuring all listed products comply with applicable Gambian laws and regulations;
  • Processing and preparing orders promptly upon receipt;
  • Maintaining appropriate hygiene, safety, and quality standards for all goods sold through the Platform;
  • Notifying INDIL promptly of any product unavailability or operational changes.

INDIL reserves the right to remove any product listing, suspend, or terminate any Merchant account that does not comply with these Terms or that receives sustained negative customer feedback.

Merchants receive order payments directly into their INDIL Business Wallet. Withdrawal to a bank account or mobile money service is available within the app. INDIL's commission structure and any applicable fees will be communicated separately at the time of business registration.

INDIL MA Service

INDIL MA is a concierge delivery service available within the Platform, enabling customers to request collection and drop-off of items, or the purchase of goods not listed in the app catalogue.

When using INDIL MA, you acknowledge that:

  • INDIL MA requests are fulfilled by INDIL riders acting on your instruction;
  • You are responsible for ensuring the accuracy of your request, including the description of items and pick-up/drop-off locations;
  • Costs associated with purchasing items on your behalf will be charged to your account in addition to any service fee;
  • INDIL cannot guarantee the availability of requested items and accepts no liability for items that cannot be sourced;
  • INDIL MA must not be used to request the collection or delivery of any prohibited, illegal, or hazardous items.

Intellectual Property

All content on the INDIL Platform, including but not limited to the INDIL name, logo, design, software, text, graphics, images, and data, is the intellectual property of INDIL or its licensors and is protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works of any Platform content without INDIL's prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable law, INDIL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to loss of revenue, profits, data, or goodwill.

INDIL's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total amount paid by you to INDIL in the three months preceding the event giving rise to the claim.

INDIL does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Platform at your own risk.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of The Gambia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of The Gambia.

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Changes to These Terms

INDIL reserves the right to update or modify these Terms at any time. We will notify registered users of material changes via the app or by email. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates. The "Last updated" date at the top of this page indicates when these Terms were most recently revised.
